Terms & Conditions 

This document tells you the terms and conditions of Asia Football Showcase  (AFS)  Please read these terms and conditions carefully and make sure you understand them before applying to book on to the showcase. By applying to book you confirm that you fully understand and agree to these terms and conditions.

Please note that these are the only official Terms that AFS agrees to. No other condition publications are to be used as formidable proof of AFS policies. If there are any doubts to the conditions please refer to the most recent policies on the Asia football showcase website. Please note that the only valid FAQ's are the most recent versions on the Asia Football Showcase website, currently FAQ's Version 4.0.

Definitions

In these Terms & Conditions the words ‘he’ and ‘himself’ are not intended to be gender specific but to apply equally and fully to all  whether male or female.

The terms ‘AFS’ and ‘us’ refer to Asia Football Showcase and any partners, associates, agents or subcontractors involved in the design, marketing or delivery of the Trials.The terms ‘Player’ and ‘you’ refer to the person who is undertaking the showcase arranged by AFS. 

Showcase Program

AFS Booking Procedure:

To book onto the event the Player must complete and return a Booking Form and Medical Consent Form, sign the declaration agreeing to the Terms & Conditions, and pay the fees. On receipt of the completed Booking Form, Medical Consent Form and the fees we will email you confirmation of your spot. 

Indicative Level.

Player Assessment:
The judgement as to which club you attend a trial, if any, is dependant of football clubs represented during the showcase.

Accommodation & Food for Additional Persons:

If required, accommodation and food can be arranged at additional cost for persons accompanying the Player. Payment for this must be received by AFS at least two weeks in advance of the date of arrival.  

Airport Transfers:
Unless specifically stated otherwise Airport Transfers are not included in the showcase package. Where Airport transfers are included in the showcase package we require your flight details at least one week before the start of the Trial. In the absence of such details, we cannot guarantee the airport transfers. The Airport Transfers do not include any charges made by airlines for unaccompanied minors which should be paid locally when the flights are booked.

Right to Vary:
If you attend a trial, it is delivered by a football club and not directly by AFS, and as football clubs are subject to changeable requirements in terms of their player recruitment needs, match and training schedules, and availability of coaching and physical resources.

Medical Consent:

By booking the event you give your permission to AFS to arrange for medical treatment to be given either by way of first aid by a suitably qualified person or if deemed necessary by being taken to a doctor or hospital.

Medical Insurance:

Unless specifically stated otherwise Medical Insurance is not included in AFS events packages. It is your responsibility to ensure that any such condition is met.  

You must take out Travel Insurance before attending the event. AFS is not responsible or liable for any costs incurred by you in respect of illness and or injury.  

Contract Negotiation:
By being a Trialist at a club you acknowledge and accept that you are an ambassador of the club at which you are having a Trial and of AFS. As such you agree to adhere to the regulations and rules of behavior of the club and avoid putting yourself in a situation that could damage or disparage the reputation and or image of the club, and or of AFS, and or that could bring the game of football into disrepute.

Disciplinary Action:

You accept and agree that if you fail to abide by the expected standards of conduct and behavior AFS has the right to terminate the Showcase programme forthwith without notice or compensation. If your participation is terminated it is your responsibility to organize and pay for any travel, accommodation or other expenses incurred because of such termination.
Further, such breach of the expected standards of conduct and behavior may result in you being reported to your club and or your national Association for any further disciplinary action that they deem appropriate.

Permissions to Participate:

If you are already contracted to a football club you should obtain confirmation in writing from them of their consent to attend AFS. If the dates of AFS involve you missing school then you should obtain the schools written consent to your being absent for the showcase. If you are under the age of 16 we will require a letter consenting to your participation from your parent or guardian.  

Other Attendees:

Parents, guardians, agents or other representatives may attend the showcase. Where such permission is granted such persons should remain outside the field of play and, where provided, within any designated area. Such persons are expected to adhere to the same standards of conduct and behaviour as the Player and team staff. If they fail to observe the expected standards of conduct and behaviour this may result in such persons being asked to leave the event. 

Refund Policy

Cancelation or rescheduling AFS events:

If the showcase is canceled by AFS you will be offered the event on alternative dates agreeable to you and AFS. If you fail to appear to the event that you booked, no refund will be given and all bookings are non-refunable and can not be amended or modified. 

Unless the player has previously purchased Worry-Free Protection - Showcase Cancellation/delay on the checkout cart via the payment link at the exact time of the booking order, no refund will be given and all bookings are non refunable and can not be amended or modified. 

If the player or supporter is unable to proceed with his or her program due to covid-19 AFS will not be held liable in anyway for a refund.

Refusal of Visa: 

AFS is not responsible for visas. Your booking is made in full to the necessary vendors and in the event you do not meet the requirements of attaining a visa you will not be granted a refund. AFS are only intermediaries for the exchange of the bookings.  The player should make sure that all visa requirements are achievable by contacting or visiting the embassy or consulate, this should be done before making payment to AFS as all bookings are non refunable and can not be amended or modified. To ensure the player's visa is granted,  sufficient time should be made to allow attendance at the showcase. If you are refused entry on arrival, no refund will be given.

In a possible event that AFS is held responsible for the VISA not being granted, a refund will be provided prevailing currency exchange rates and subject to an administration fee of US 100(US Dollars) subject to you having taken all steps necessary to ensure the visa is granted in sufficient time to allow attendance at the showcase.  AFS will  require a copy of the original documentation issued by the Entry Clearance Officer stating that the visa application has been declined at least 1 month prior to the showcase start date. As an alternative, we may offer you an alternative dates agreeable to you and AFS for a future showcase. 

Fitness:

You are responsible for ensuring that you are physically fit and able to participate in the sporting activities involved in the event. AFS will not issue a refund because a Player is not physically fit enough to participate in a event. If you suffer illness or injury after the event has been confirmed but before the event has started we will reschedule the event on the same terms as originally agreed subject to receipt of a medical certificate. 

General:

In all other circumstances once the event has been confirmed the fee is non-refundable. 

Sundry

Your Liability:

You are responsible for the cost of any damage caused by you during the event to any property, facilities or equipment and you will be liable to pay such cost. 

Our Liability:

You are advised not to bring items of value to the event. AFS will not be held responsible for any damage to or loss of your personal property.

You understand and agree that you take part in the event at your own risk and that AFS will not be held liable or responsible for any accident, injury or illness suffered by you during the Trial. 

Discounts, Codes Validity and Usage Clause:

In the event of any discrepancy or contestation regarding the timeline or validity of a discount code, the official discount code as presented on the website link: https://asiafootballshowcase.com/packages shall take precedence and supersede any other schedules, written discounts, or communications. To avail the discount, participants must enter the applicable promo code at the time of purchasing the package. If the participant fails to enter the promo code during purchase, the discount will not be applied. We are not liable for forgotten or misused promo codes. Under no circumstances will refunds be issued due to promo code oversights, nor will the discount be transferred to another product or package. Users are advised to refer to the aforementioned link to confirm the current and valid discount codes before making any transactions.

Image Rights:

You agree to grant AFS a worldwide right, in perpetuity and without the need for approval or compensation, to use your name, photograph, video or film portrayal, image, likeness, interview, voice or sound in any media whatsoever for advertising, promotional or other commercial purposes.

Communication:

All communications relating to the event must be with or made through AFS

Waiver:

If AFS fail to insist upon the strict performance of any of your obligations, or if we choose not to exercise any of the rights or remedies to which we are entitled, this will not be a waiver of such rights or remedies and will not relieve you from complying with such obligations. 

A waiver by AFS of any breach by you will not constitute a waiver of any subsequent breach. No waiver by AFS of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

Severability:

If any court or other competent authority determines that any of these provisions is invalid, unlawful or unenforceable to any extent, the term will, to that extent, be severed from the remaining terms, which will continue to be valid to the full extent permitted by law.

Entire Agreement:

These Terms & Conditions contains and represents the entire agreement between AFS and the Player, team staff, parent and supersedes all prior agreements, representations or understandings, oral or written, express or implied with respect to the event. 

These Terms & Conditions may not be modified or amended in any way unless in writing and signed by AFS and the Player. No representation, promise or inducement has been made by AFS that is not embodied in this Agreement, and AFS shall not be bound by or liable for any alleged representation, promise or inducement not specifically set forth herein.

Force Majeure 

AFS shall not be liable for delays or errors occurring by reason of circumstances beyond its control, including but not limited to acts of civil or military authority, national emergencies, work stoppages, fire, flood, catastrophe, acts of God, COVID-19, insurrection, war, riot, or failure of communication or power supply. In the event of equipment breakdowns beyond its control, the Sub-Advisor shall take reasonable steps to minimize service interruptions but shall have no liability with respect thereto.

Failure to Appear:

Failure to appear without just cause to AFS events:

If the showcase is canceled by AFS you will be offered the event on alternative dates agreeable to you and AFS. If you fail to appear to the event that you booked, no refund will be given and all bookings are non refundable and cannot be amended or modified. 

Unless the player has previously purchased Worry-Free Protection - Showcase Cancellation/delay on the checkout cart via the payment link at the exact time of the booking order, no refund will be given and all bookings are non refundable and cannot be amended or modified. 

Counterparts and Agreement to terms and conditions:

This agreement may be executed in one or more counterparts, each of which shall be deemed to be an original and all of which, when taken together, shall be deemed to be one and the same agreement or document. The application will confirm this agreement transmitted by facsimile, email or other means of electronic transmission shall be deemed to have the same legal effect as delivery of an original executed copy of this agreement for all purposes.

Jurisdiction:

These terms and conditions and your booking shall be governed by and interpreted in accordance with the law of Thailand and shall be subject to the non-exclusive jurisdiction of the Thailand courts.

Declaration Player's name

By signing this document, you agree and acknowledge that you are over 18 years of age and that you have read, understand and agree to the Terms & Conditions under which this Event is offered.

WORRY-FREE DELAY BENEFIT  & CANCELLATION 

The Worry-Free product declares, agree and warrant the following:

• To provide flexibility, bookings made with this plan will be permitted a one-time change to an AFS program without an additional fee.
• Change fees are waived. No waiver is required. Please follow the standard exchange process, and the charge will be $0.
• For AFS clients who have paid for this policy and are unable to attend the showcase, change allowance for AFS will be allowed for the next one (1) upcoming showcase that AFS provides.
• If AFS package costs increase within the change allowance period stated above, clients need to pay the difference in cost.
• AFS has full authority over this policy issued and the policy may be void at the Company's option if the player does not re-register with minimum two (2) months prior to the next one (1)  upcoming showcase AFS provides. Late registration will not be accepted. Re-registration is limited to one (1) time only for the same program. 
• Program upgrades at an additional cost difference are allowed. Program downgrades are not allowed.
• This insurance does NOT cover clients whom contract covid-19 or any other disease.  
• If the worry free insurance is to be used with 0%  fee, the player must notify the AFS director no later than 30 days before the his event start date.
• If the worry free insurance is to be used, the player must be claim the policy 4 weeks before the event start date or a 20% fee will be applied. 
• If the worry free insurance is to be used the player must be claim the policy no less than 3 weeks before the event start date or a 30% fee will be applied. 
• If the worry free insurance is to be used the player must be claim the policyd 2 weeks before the event start date or a 40% fee will be applied. 
• If the worry free insurance is to be used the player must be claim the policy 1 week before the event start date or a 50% fee will be applied. 
• If the worry free insurance is to be used the player must be claim the policy  less than 1 week before the event start date or a 60% fee will be applied. 

a. All written information provided in the  application/payment page, or any formal questionnaire or other confirmation signed by you in conjunction with this application, and statements and answers are so made to the POI Group LLC (hereinafter referred to as "the Company") and are full, complete, true and correct, and shall form the basis of the contract of Worry-Free Application. Upon purchase of this item you understand and agree that the Company, believing them to be such, will rely and act on them. If the information given is not full, true and/or complete, any policy issued may be void at the Company's option.

b. Upon purchase you hereby irrevocably authorize The POI Group LLC and/or its affiliates to fully release any personal information collected or held by them to the Company for the purpose of this Worry-Free Policy/or for the matters stated in item (c) below.

c. Any personal information collected or held by the company (whether contained in this application or otherwise obtained)  may be held, used and disclosed by the Company to individuals, service providers and organizations associated with AFS or any other selected third parties (within or outside of Thailand, including insurance, reinsurance and claims investigation companies and industry associations) for the purpose of processing this application and providing subsequent service for this and other financial products and services, direct marketing and data matching, and to communicate with AFS for such purposes. You understand that AFS has the right to obtain access to and to request correction of any personal information held by the AFS concerning me/us. Such request can be made to any of the company's Customer care team.

d. Furthermore, you hereby irrevocably authorize any organization, institution or individual that has any records or knowledge of this information shall be binding / the Proposed Assured, successors and assigns, and remain valid, notwithstanding /the proposed Assured. A copy of this authorization shall be as valid as the original.

e. Coverage applies only within the country of event and showcase cover is only limited to AFS Events.

1. Refund Eligibility: To qualify for a refund, participants must submit a written cancellation request to the official AFS email no later than one (1) month before the event's start date. Requests received after this deadline will not be eligible for a refund.
2. Worry-Free Refund Insurance: Participants who have opted for the Worry-Free Refund Insurance will be entitled to a refund as per the insurance terms.
3. Deductions: The refund will be processed after deducting any conversion rate variances and transfer fees that may arise during the refund process. These deductions cover expenses related to foreign currency conversion (if applicable) and any associated bank or transaction fees. Additionally, a flat administrative fee of 50 USD will be applied.
4. Refund Process: Upon receipt of a valid cancellation request, the AFS team will initiate the refund process. Please note that the timeline for receiving the refund may vary depending on the payment method, banking institutions, and other factors such as tax, etc.
5. Limitation of Liability: AFS bears no responsibility for third-party fees, such as credit card fees, bank charges, and foreign exchange fees, which may be deducted from the refunded amount.
6. Contact Information: For all refund inquiries, please direct your requests to HR@asiafootballshowcase.com. It is imperative to obtain confirmation of receipt for your refund request. If you do not receive this confirmation within 9 to 15 business days, please follow up with our team to ensure the request has been received.
7. By registering or paying for the AFS event, participants acknowledge and accept the terms outlined in this refund clause.

Under no circumstances will AFS be held responsible or liable for any player or supporter contracting the covid-virus or any diseases related to covid-19 before, during, or after attending the AFS program or third party hosts arranged by AFS. By signing and submitting the application form or submitting a transfer of payment the player/supporter confirms his or her acknowledgment to this clause and is in agreement. 

The information, software, products, and services published on this website may include inaccuracies or typographical errors. Changes are periodically added to the information herein. AFS and/or its suppliers may make improvements and/or changes in this website at any time without prior notice. AFS and/or its suppliers make no representations about the suitability of the information, software, products, and services contained on this website for any purpose. All such information, software, products, and services are provided “as is” without warranty of any kind. AFS and/or its suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, and services, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement. In no event shall AFS and/or its suppliers be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with the use of this website or with the delay or inability to use this website, or for any information, software, products, and services obtained through this website, or otherwise arising out of the use of this website, whether based on contract, tort, strict liability or otherwise, even if AFS and/or any of its suppliers has been advised of the possibility of damages. 

ALL payments are Non-Refundable Payments to the player Residential program. (Where a players is in the care of AFS or the director Ryan Reece)  The player acknowledges that the Deposit is non-refundable in all circumstances, including but not limited to if the buyer decides they do not want or are no longer able to continue the program. Upon receipt of the payment, AFS agrees to manage funds in anyway the company AFS deems fit. The payment is to be paid in US Dollars and paid to Ryan Reece via payment through international bank transfer. The buyer agrees to ALL terms and conditions written on www.AsiaFootballShowcase.com/legal

As a condition of use of this website, the User agrees to indemnify AFS and its suppliers from and against any and all liabilities, expenses (including attorney's fees) and damages arising out of claims resulting from User's use of this website, including without limitation any claims alleging facts that if true would constitute a breach by User of this Agreement.

This website is offered to the User conditioned on acceptance by the User ("User" or "you") without modification of the terms, conditions, and notices contained herein. By accessing and using this website, the User agrees to be bound to all such terms, conditions, and notices, including AFS Privacy Policy (the "Agreement").

User represents and warrants that he or she possesses the legal right and ability to enter into this Agreement and to use this website in accordance with all terms and conditions herein. User agrees to be financially responsible for all use of this website. User agrees not to assign, transfer or sublicense User rights pursuant to this Agreement. The reservation features of this website are provided solely to permit User to determine the availability of event related goods and services and to make legitimate reservations or otherwise transact business with suppliers, and for no other purposes. Without limitation, User shall not make any speculative, false or fraudulent purchase or reservation, or any reservation in anticipation of demand. In the event AFS determines that an individual has confirmed such reservations to one or more event(s) on or about the same date(s), AFS reserves the right to cancel all confirmed space associated with the multiple reservations without notice to the passenger or the person making the booking. User agrees that the reservation features of this website shall be used only to make legitimate reservations or purchases for User. User agrees to abide by the terms or conditions of purchase imposed by any supplier with whom User elects to deal including, but not limited to, payment or redemption of all amounts when due and compliance with all rules regarding availability of fares, products or services. User shall be completely responsible for any and all charges, fees, duties, taxes and assessments arising out of the use of this website.

This website is for the User's personal, noncommercial use only. User agrees not to modify, copy, alter, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from this website without AFS prior written permission. User agrees not to use any robot, spider, other automatic device, or manual process to monitor or copy this website or the content contained therein or for any other unauthorized purpose without AFS prior written permission. User agrees not to use any device, software or routine to interfere with or attempt to interfere with the proper working of this website or any activities conducted on this site. User agrees not to take any action that imposes an unreasonable or disproportionately large load on our infrastructure. AFS reserves the right to investigate any illegal and/or unauthorized use of this website, including, but not limited to, unauthorized framing of this website or unauthorized use of any robot, spider or other automated device, and to take appropriate legal action, including, without limitation, civil, criminal and injunctive redress.
